2020 SDLT REVIEW

SDLT is a complex tax. So-called SDLT experts are now suing conveyancers for negligence, under conditional fee arrangements, where it is claimed too much SDLT was paid in the past. HMRC has issued comprehensive guidance on the words “dwelling” and “grounds”. The Budget in March may well introduce a surcharge for buyers from overseas. We all need to consider the impact of an anti-avoidance provision introduced in 2006 (section 75A), which the courts in 2018 decided HMRC could use to extract more tax even though no tax avoidance was taking place.

There have been far more changes in the past few years to residential SDLT than to non-residential. However, in most firms the purchase of a shop with one or two flats above it would be handled by a commercial conveyancer and yet, to calculate the correct tax, knowledge of residential surcharge and multiple dwellings relief is essential – plus (where a company is buying) the 15% higher rate and its exemptions.
